It’s been about a year and a half since the accident on a roofing job up in Westchester, and I’ve finally accepted that my shoulder is never going to be what it was before. Three surgeries later and the surgeons basically said I’ve got permanent range of motion loss and I’ll never be able to lift anything heavy overhead again, which for someone who’s done construction their whole adult life feels like having the rug pulled out from under me. The workers comp checks have been coming but they’re not anywhere near what I was making, and now they’re talking about classifying me with a permanent disability rating and potentially settling my case, but I honestly have no clue what I’m doing. One of the guys on my old crew mentioned that once they slap a permanent label on you, you really only get one shot to make sure the settlement actually reflects what your life is going to look like twenty years from now, not just right this second. I’ve been trying to wrap my head around all these percentages and ratings and medical reports and it’s making my head spin, so I finally decided I need to talk to a permanent disability workers comp lawyer NY to walk me through whether I should even consider settling or if I’m better off keeping the case open given how uncertain everything still feels. I guess I’m just wondering if anyone else here has been through the permanent disability process and can tell me whether it’s as overwhelming as it seems right now.
